SC Gives a Green Signal To Declaration of Results
The Supreme Court on Thursday gave the green signal for the
declaration of the All India Engineering and Architecture Entrance Examination (AIEEE)
results awaited anxiously by 10 lakh students, who were on tenterhooks because
of the examination paper leak and a petition seeking a fresh test for all. The court
dismissed a petition seeking a fresh common entrance test for all students citing
the leakage of question paper and fresh examination in a select few centres for
a few thousand students.
After the petition was dismissed, the Central Board of Secondary Education (CBSE)
officials told TOI outside the court that the AIEEE results would be declared within
2-3 days. On May 1, the examination paper leak made the CBSE defer the entrance,
held for preparation of the merit list for over 40,000 seats in engineering colleges,
by three hours and conduct a fresh test in select centres on May 11.
A bench comprising Justices G. S. Singhvi and C. K. Prasad understood petitioner
Dr. A. P. Sinha's concern for the students who felt discomfited by the abrupt change
of AIEEE timings on May 1 as well as the fresh test for a few thousand students.
However, it did not agree with petitioner's counsel Praveen Agarwal that it would
confer an advantage to a few thousand students and discriminate against lakhs of
others. Dismissing the petition seeking a fresh examination, the bench asked CBSE's
counsel and senior advocate Altaf Ahmed why the results have not been declared.
Ahmed informed the bench that the results have been compiled and the CBSE was waiting
for the outcome of the petition pending before the apex court. A dismayed bench
asked : Can results involving lakhs of students be stayed.
The pendency of petition cannot be taken as a restrain on the authorities not to
declare the results, the bench said and impressed upon the petitioner that even
if the examination was held smoothly, those who do not do well would always have
a grievance against the system.
